Services on the PODTALK.co.uk website or directly from PODTALK.co.uk are accepted subject to the following conditions:

Warranty. The placing of an order for any Service with PODTALK.co.uk constitutes a warranty from the Customer and/or Advertising/Design Agency acting on behalf of the Customer.

Honest: That the Customer is legal, decent, honest and truthful.

That the Customer’s business/company/individual complies with UK Law and the Law within their own jurisdiction.

Third Party Damage: That the work or Service carried out by PODTALK.co.uk is not used in any defamatory way and does not infringe the copyright, moral rights or any other rights of any third party.

Indemnity. The Customer/or advertising/design agency agrees to indemnify the Company, PODTALK.co.uk in respect of all costs, claims, damages, or other charges arising directly or indirectly as a result of any service, virtual, audio or physical supplied by PODTALK.co.uk. This indemnity also covers any PODTALK.co.uk employee, partner, director, third company service, customer, consultants, associate and affiliate.

Guarantee of Services. While every effort will be made to meet the wishes of a Customer, the Company, PODTALK.co.uk does not guarantee Services and has the right to refuse Services without explanation. PODTALK.co.uk has the right to refuse or cancel any Service to any Customer.

Errors. It is the responsibility of the Customer to check any Service provided from PODTALK.co.uk before their own publication or use. The Company, PODTALK.co.uk will take no responsibility for any Service provided to its Customers, virtually or physical, paid or unpaid. Customers must check Services provided by PODTALK.co.uk before using them. PODTALK.co.uk is happy to make small adjustments to work supplied through its Services. Adjustments/alterations will be made at a convenient time for the Company, PODTALK.co.uk.

Responsibility. PODTALK.co.uk will be not be responsible, or liable, for any circumstances outside its full control and will not be responsible for any error by the Customer with provided work. This includes incorrect information in content. The cost of a further corrective work will be reasonably comparable to that in connection with which the liability arose.

Loss. The Company accepts no liability in respect of any loss or damage occasioned directly or indirectly as a result of any works or Services supplied.

Cancellation of Service by PODTALK.co.uk: The Company may refuse any Service if already accepted, cancel the Customer’s order at any time by giving reasonable notice. The Company will not be liable to refund any outside charges but, the Company may return monies at their own discretion. The Company may require any alteration it considers necessary or desirable in any of its Services.

Refunds. Orders for Services cannot be refunded once the Company, PODTALK.co.uk, has commenced working on the order in accordance with the booking/order/confirmation as requested by the Customer. All cancellations and refund requests must be notified in writing via email.. It is the responsibility of the Customer to retain a note of any ‘stop number’ issued by the Company. PODTALK.co.uk will not refund for any Service which is paid for in advance on PODTALK.co.uk for immediate download – eg: Courses, Training manuals, advice sheets etc.

Copyright. The copyright for all purposes in all artwork, copy, video, audio and other material which the Company or its employees have originated, contributed to or reworked shall vest in the Company. The Customer authorises the Company to record, reproduce, publish, distribute and broadcast (or to permit the same) all content (including, but not limited to text, artwork, video, audio and photography) and to include and make them available in any information service, electronic or otherwise.

Consents. The placing of an order for any Services by the Customer, or an advertising agency on behalf of a client, constitutes an assurance that all necessary authority and consents have been secured in respect of the use of content (a) of pictorial or any other representations of (or purporting to be of) living persons, and of references to any words attributed to living persons and (b) any material the copyright in which vests in a third party.

Risk. Any material, in any format, submitted by the Customer is held/stored by the Company at the Customers’s risk and should be insured by the Customer against loss or damage from whatever cause. The Company reserves the right to destroy/delete without notice all such property after the Service is complete and paid for unless given specific instruction by the Customer.

Prices. The prices charged for any Service shall be those set out in the Company’s price list which is available on personal request. The Prices are subject to change at any time. It is the responsibility of the Customer to bring to the Company's attention at the time of booking any discount, allowance or exemption from VAT (Value Added Tax) to which entitlement is claimed.

Payment: Payment must be made by PayPal or directly to the Bank Account numbers given at the time of ordering a Service. On receipt of your payment we will issue you an electronic receipt. The electronic receipt will be sent to your given email address from your registration information. We do not charge VAT. Prepayment is required for most of our Services, please contact the Company regarding invoicing facilities.

Disclosure of Identity. The Company reserves the right to disclose the name and address and any other account details of advertisers and/or agencies to the police, trading standards officials, or any other relevant authority and, where the Publisher in its sole discretion deems it reasonable, to other third parties.

Customer Business Orders. Service orders must be issued by Business Customers and advertising agencies.

Acceptance of Order The placing of an order for Services shall amount to an acceptance of the above terms and conditions.

Delivery of Services. The Company will commence on your order of Service as soon as reasonably practicable from the receipt of your payment, unless exceptional circumstances or events beyond our reasonable control prevent the Company from doing so. Services may be affected by certain situations or events that occur that are not within the Company’s reasonable control (some examples are given below). Where one of these occurs we will attempt to recommence performing the delivery of your Service as soon as the situation which has stopped us performing the Service or has been resolved. In such circumstances there may be a delay (sometimes a substantial delay) before we can start or continue with the service. The following are examples of events or situations which are not within in our reasonable control:
